Terms of Service

1. Provider and contact

Superphoto is provided by APPTO INNOVATIONS ΙΔΙΩΤΙΚΗ ΚΕΦΑΛΑΙΟΥΧΙΚΗ ΕΤΑΙΡΙΑ, trading as SuperPhotoBNB, at ΝΕΑΠΟΛΕΩΣ 53, 15123 ΜΑΡΟΥΣΙ, ΕΛΛΑΔΑ. Registration number: Γ.Ε.ΜΗ. 124121201000. VAT ID: EL800467530. Contact: hello@superphotobnb.com.

2. Accounts and eligibility

You must be at least 18 and able to enter a contract. Provide accurate information, keep your login secure and notify us promptly of unauthorised use. You are responsible for activity through your account. We may suspend access where reasonably necessary to protect users, investigate misuse, comply with law or prevent harm.

3. The service and AI results

Superphoto is an automated editing tool. It processes property photographs, suggests classifications and creates AI-enhanced images, but it does not inspect the property, verify the original photograph or approve any image for publication. AI output is probabilistic and may be inaccurate, unexpected, technically imperfect or may add, remove, relocate or alter visible details, colours, lighting, views, furnishings, dimensions or other characteristics.

Your review and approval are essential. You—not Superphoto—make the final decision whether an original or enhanced image is accurate, lawful, suitable and safe to publish or deliver to a client. Before any use, you must compare the output with the real property and the original image, correct or reject misleading output, obtain any client or owner approval required by your agreement, and comply with advertising, consumer-protection, property-listing and platform rules. Do not use an output if you cannot verify it.

Superphoto does not provide legal, photographic, architectural, valuation, advertising or platform-compliance advice and does not guarantee that an output is unique, copyrightable, non-infringing, accepted by a third-party platform, or capable of increasing views, rankings, bookings, revenue or guest satisfaction.

Experimental presets. A preset marked “Experimental” has not been verified for consistent performance. It may work perfectly, but it may also cause minor or significant alterations that reduce the photo’s fidelity to the real property. You choose to use Experimental presets at your own risk and must review every result carefully before publishing it. To the maximum extent permitted by applicable law, Superphoto is not liable to compensate you merely because an Experimental preset produces an unsatisfactory result or an alteration of this kind. This does not limit any remedy for failure to supply the service, lack of conformity, or any other consumer right that cannot legally be excluded.

We may improve, add or retire features. If a material change substantially reduces a paid service, we will provide reasonable notice where practicable and any remedy required by law.

4. Your content

You retain your rights in content you upload. To the extent recognised by applicable law, any rights you acquire in an output belong to you. Superphoto does not promise that AI-generated or AI-modified material qualifies for copyright protection or that an output will not resemble material created for another user.

You grant us a limited, worldwide, non-exclusive licence to host, copy, process, modify and transmit your content only as needed to operate, secure, troubleshoot and support the service. This licence ends when the content is deleted, subject to temporary backups, dispute preservation and legal retention duties.

Your rights warranty. For every upload, import, instruction and requested use, you represent and warrant that you own the material or have all licences, permissions, releases and lawful bases needed to let us process it and to create, download, share, publish and commercially use the result. This includes copyright and related rights, database rights, contractual rights, confidentiality duties, privacy and data-protection rights, publicity/personality rights, and permission from the property owner, photographer, agency, platform or identifiable person where required.

You must not upload or import material copied from a listing, photographer, agency, platform or other third party merely because it is publicly viewable. You must not use the service to remove ownership notices, create a deceptive property listing, impersonate another person, or infringe intellectual-property, privacy or other rights. We may reject, disable or remove content and suspend access when we reasonably suspect a violation, but we do not undertake to pre-screen or legally clear your content or output.

You are responsible for shared-gallery links, their recipients and any publication or onward distribution of originals or outputs. If you learn of a rights dispute, inaccurate depiction or other legal risk, you must stop using the affected material and promptly notify us.

5. Your clients, listings and business decisions

Superphoto is not a party to any agreement between you and a property owner, guest, tenant, photographer, agency, booking platform or other client or third party. You remain solely responsible for your professional work, client instructions and approvals, listing accuracy, disclosure that an image has been enhanced where required, and the decision to publish, deliver, rely on or remove any image.

Any complaint, refund, compensation request, cancellation, lost booking, platform action or third-party claim arising from your original content, your client relationship, your failure to review an output, or the way you use or describe an image remains your responsibility, except to the extent directly caused by Superphoto's breach of a non-excludable legal duty.

6. Coins, prices and payment

Coins are prepaid units used only for eligible Superphoto processing. They are not money, stored value, transferable property or redeemable for cash. The checkout shows the pack, total price, currency and applicable tax before purchase. Stripe processes payment. Coins are credited after confirmed payment and deducted according to the enhancement option shown in the app.

Unless checkout explicitly says otherwise, coin packs are one-time purchases and do not renew automatically. We may change future prices or coin costs, but changes do not alter completed purchases. We may correct an obvious pricing or crediting error and will provide the remedy required by law.

7. Immediate performance and withdrawal

If you are an EEA/UK consumer, you may have a statutory cancellation period for a distance contract. When you ask us to provide digital services or content immediately, checkout may ask for your express request to begin before that period ends and your acknowledgement that the right of withdrawal may be lost once the digital content is supplied or the service is fully performed. This does not remove rights that cannot legally be waived.

8. Acceptable use

You must not probe or bypass security; scrape or overload the service; automate access without permission; resell accounts or coins; reverse engineer protected parts of the service; upload malware; impersonate others; infringe rights; or use generated images to misrepresent a property or deceive guests. Third-party imports must use content you are authorised to process and must comply with the third party's terms.

9. Intellectual property

Superphoto, its software, interface, brand, templates and documentation are owned by us or our licensors. Apart from your content, no rights are transferred to you. We give you a limited, revocable, non-exclusive right to use the service in accordance with these Terms.

10. Availability, third parties and liability

We aim to provide a reliable service but cannot promise uninterrupted or error-free operation. To the maximum extent permitted by law, Superphoto is provided without implied warranties beyond those that cannot be excluded. Nothing in these Terms excludes liability for fraud, wilful misconduct, death or personal injury caused by negligence, or consumer rights and other liability that law does not allow us to exclude.

We rely on third-party hosting, storage, authentication, payment and AI providers and on internet and platform services outside our control. We are not responsible for a third party's independent acts, outages, policy changes, content removal or account action, although this does not excuse our own obligations under applicable law.

Subject to the first paragraph of this section, Superphoto is not liable for indirect, incidental, special, exemplary or consequential loss; loss of profits, revenue, goodwill, data, opportunity, ranking, clients or bookings; business interruption; guest or client compensation; platform penalties; or claims arising from content or output that you published, supplied or relied on without the review and authority required by these Terms.

For users acting in the course of business, trade or profession, our aggregate liability arising out of or relating to the service is limited to the total amount paid to Superphoto in the 12 months before the event giving rise to the claim. This cap does not apply where liability cannot lawfully be limited. Consumer remedies for failure to supply or lack of conformity remain unaffected.

11. Business-user indemnity

If you use Superphoto for a business, trade or profession, you will defend, indemnify and hold harmless the provider and its directors, personnel and service providers from third-party claims, damages, judgments, settlements and reasonable legal costs to the extent arising from: (a) content you upload, import, share or publish; (b) your lack of required rights, licences, releases or approvals; (c) an inaccurate, misleading or unlawful listing or use of an output; (d) your client relationship or breach of a client or platform agreement; or (e) your material breach of these Terms or applicable law.

This indemnity does not apply to the extent a claim was directly caused by Superphoto's own breach, negligence, wilful misconduct or other liability that cannot lawfully be excluded. It does not reduce mandatory consumer rights.

12. Claims concerning content

If we receive a credible claim that content or an output infringes rights or is unlawful, we may preserve relevant records, restrict access, remove the material and provide information where legally required. You agree to provide accurate information and reasonable cooperation. Rights holders may contact hello@superphotobnb.com with identification of the work or right, the disputed material and a good-faith explanation of the claim.

13. Ending use

You may stop using Superphoto or request account deletion. We may terminate or suspend for a material breach, unlawful use, security risk or legal requirement, normally giving notice where appropriate. Terms that by nature should survive termination remain in effect, including ownership, payment obligations and liability provisions.

14. Governing law and changes

These Terms are governed by Greek law and the courts of Athens, Greece, without depriving consumers of mandatory protections or access to courts available under the law of their residence. We will give reasonable notice of material changes; continued use after the effective date means the updated Terms apply.
